DUI and DWI
Pulled over, tested, charged
A DUI arrest starts two cases at once: the criminal charge in court, and a separate fight over your license that has its own deadline.
The license deadline is short, often days rather than weeks, and missing it can cost you your license before the court case even starts. So the first thing I do is file for the hearing.
Then I get the stop on video. Body camera, dashcam, the breath test machine's records. Plenty of DUI cases are decided by what the video shows about the first two minutes.
What I handle
A first or second DUI or DWI
A refused breath test
A DUI with an accident or a passenger
A commercial driver's license at risk

What happens next
From the traffic stop to the last court date
Most first DUI cases follow this run. Yours may skip a step or add one.
- 01
Step 1: This week
We talk, I quote the fee, and I request the license hearing before its deadline passes.
- 02
Step 2: The license hearing
I question the officer's paperwork and the test. The aim is to keep you driving, sometimes with a restricted license.
- 03
Step 3: Discovery
I get the video, the test records and the officer's report, and go through them with you line by line.
- 04
Step 4: Court
A dismissal, a plea to something less, probation without a conviction, or a trial. You decide which, once you've seen what I've seen.
DUI questions
Should I have refused the breath test?
It's done either way, and both can be defended. A refusal has its own license penalty, so tell me which it was on the first call.
Can I keep driving to work?
Often, yes, with a restricted license or an ignition interlock. It depends on the test result and your record.
Is a first DUI a jail case?
Usually not, but it can be with a high reading, an accident or a child in the car. I'll tell you plainly where yours sits.
The license deadline is already running
Call or text today and I'll file for the hearing this week.
